Participation and Departure

Your Participation: Your paid fee entitles you to a “seat space” in the class designated, for a consecutive 4-week timeframe (session). Classes meet once per week, for a length of time established in your Agreement (generally 1 to 2 hours). An actor’s decision to interrupt their attendance is understood, as it may be unavoidable. However, your absence will in no way, under any circumstance, be made up at a later date, or reimbursed. Your 4-week timeframe is established by, and begins from, the date of your confirmed and fully paid Agreement. Class continues whether or not an actor participates. The Actors Room encourages all actors to get the most out of their training by being consistent and prepared each week. In some, prearranged, circumstances it may be permitted for an actor to participate in class remotely (examples: illness, out of town). This exception is permitted only if another actor (in that class) is willing to monitor your participation from their personal phone or laptop.

Returning For An Additional Class Session: Payment, in full, is required a week prior to the beginning of a new 4-week class session. A maximum late fee of $50.00 or possible forfeiture of seat may occur if payment is not received on time. This Agreement is “Self-Renewing”, as such; a new application is not needed at the beginning of each new session. This online Agreement will be extended (remain enforced) when payment for the next session is received. If no indication of departure is given, payment is required in full and all rules, regulations, terms, Agreements, understandings, are considered to remain enforced and your seat space will not be given away.

Missing Or Departure From Class: If missing a class is necessary, please communicate with as much notice as possible as it may impact your class peers, etc. A private communication group has been established for all actors to reach out as needed. Any extended interruption will require a new application and acceptance may be declined for a variety of reasons, including but not limited to, lack of seat space. Written or other clearly indicated statement of departure is required by the participant, at least 5 days prior to departure

Note: If the participant is a minor, emergency contact name and phone number are mandatory for the application to be processed. For participants 18 years or older who do not provide emergency information, 911 will be called in case of an emergency. While efforts will be made to contact the information provided, the participant’s health, safety, and wellbeing are our primary concern. It is the responsibility of the participant or their guardian to ensure this information is accurate and up-to-date.

I hereby authorize and give my consent to The Actors Room and its representatives to seek medical treatment for the above-named child, in the event of an emergency or life-threatening incident.

I declare that I am the parent or legal guardian of the above-named child. This authorization and consent shall remain valid until revoked by me in writing.

1. In consideration for my participation in “The Actors Room” all divisions, I hereby hold harmless release, waive, discharge and covenant not to sue The Actors Room, its trustees, officers, agents, affiliates, subsidiaries and employees from any and all liabilities, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including emotional and/or psychological trauma and/or death, that may be sustained by me, or to any property belonging to me, while participating in any and all such activities.

2. To the best of my knowledge, I am not aware of any personal physical disability or health-related reasons or problems, including emotional, mental and/or psychological conditions, which would preclude or restrict my participation in this activity and/or create an unsafe, volatile and unstable environment or situation. I am fully aware of the possible risk and hazards connected with the physical, emotional and psychological demands of an actors’ workshop, scene study, coaching exercises, private lessons, stunts and all other related activities and I hereby elect to voluntarily participate in said activity. I voluntarily assume full responsibility for any risk of loss, property damage, or personal injury, including emotional and/or psychological trauma and/or death that may be sustained by me, or any damage to property owned by me, as a result of being engaged in such an activity.

3. I have adequate health insurance necessarTo the best of my knowledge, I am not aware of any personal physical disability or health-related reasons or problems, including emotional, mental and/or psychological conditions, which would preclude or restrict my participation in this activity and/or create an unsafe, volatile and unstable environment or situation. I am fully aware of the possible risk and hazards connected with the physical, emotional and psychological demands of an actors’ workshop, scene study, coaching exercises, private lessons, stunts and all other related activities and I hereby elect to voluntarily participate in said activity. I voluntarily assume full responsibility for any risk of loss, property damage, or personal injury, including emotionaly me, or any damage to property owned by me, as a result of being engaged in such an activityy to provide for and pay any and all medical costs that may directly or indirectly result from my participation in this activity. I agree to indemnify and hold harmless The Actors Room, its trustees, officers, agents, affiliates, subsidiaries, and employees from any loss, liability, damage or costs, including court costs and attorney’s fees that may be incurred, due to my participation in said activity.

4. It is my express intent that this Release and Hold Harmless Agreement shall bind my family, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a release, waiver, discharge, and covenant not to sue The Actors Room, its trustees, officers, agents, affiliates, subsidiaries, and employees. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of California.

In physically or digitally signing this release, I acknowledge and represent on my behalf or the individual I am signing on behalf of, binding them by the same, that I have read the foregoing Waiver of Liability and Hold Harmless Agreement, I understand and I agree to it voluntarily; nooral representation, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute the

Release for full, adequate and complete consideration fully intending to be bound by the same.

I understand that photos and/or recordings may be taken of me, from time to time, while participating at The Actors Room. As such, I do hereby confirm and agree to be photographed and/or recorded in connection with my participation at The Actors Room. I hereby grant and authorize The Actors Room, your successors, assigns and licensees, to use my likeness in and with all promotions, social media, website, videos, stills, solicitation, and the like, which you may make of me, as you deem appropriate, provided it is within the fair scope of use originally intended herein. I understand that I shall receive no compensation for said usage of my likeness. I agree to hold The Actors Room, and any third parties, harmless against any liability, loss or damage (including reasonable attorney’s fees) caused by or arising from said usage or any utterance made by me or material furnished by me in connection with my participation therein.

If a participant feels additional and/or a more expert opinion is needed, in making choices that may impact the outcome of their career or personal decisions, The Actors Room recommends they do so. The Actors Room, its presenters, representatives and all other affiliates can in no way be held responsible for what its participants personally decide to do with the information received while attending the class.

When scheduling a private lesson, the coach is obligated to schedule nothing else during that timeframe. The space is held exclusively for you. If it’s unavoidable, and the actor must cancel the lesson, the following should be taken into consideration.

How to Cancel:
All cancellations must be no later than 48 hours prior to the scheduled lesson to avoid a “Cancellation Fee”. The Coach must be contacted by phone, text, or email. Social media correspondence will not be accepted as proper notification.

Cancellation Fee Structure:

•  48-hour notice of cancellation, totaling 50% of the required payment.
• 24-hour notice of cancellation, totaling 75% of the required payment.
• No cancellation notice, totaling 100% of the required payment.
• Payments are due immediately, using a form of payment acceptable to The Actors Room.

Rescheduling:
Changing a scheduled private lesson is permitted, provided space is available and changes are made at least 72 hours in advance. Changes can be requested by phone, text, or email. The Actors Room is not obligated to reschedule, or responsible for rejected requests due to availability or other time constraint issues.

Coach Cancellation:
If the coach must cancel a private lesson, for any reason, a one-time discount of $25 will be applied to the actor’s next private lesson. The discount is nontransferable. It is the actor’s responsibility to reschedule. If the lesson is not rescheduled within a 3-month time period, no discount will be issued.

It is The Actors Room commitment to continually provide a safe, welcoming, professional and functional environment for all actors to accomplish their goals. There is a sincere respect for the talent that come to work, learn and grow at The Actors Room - the atmosphere and décor reflect that.

As such, The Actors Room asks that all Clients/Participants also treat the space with a common respect and professionalism. The Actors Room management understands that it’s normal for accidents to occur from time-to-time. For that reason, Clients/Participants understand that if they are responsible for any loss or damage (whether intentional, unintentional or due to negligence) to property owned, rented and/or purchased by The Actors Room (including but not limited to; internal/external structure, furniture, appliances, décor, equipment, keys, etc.), all items lost or damaged will be replaced or
repaired (management’s choice) at the fair, current (“Current” is defined by the date damage is committed) market value at a non-devalued, depreciated or prorated cost and replaced within 5 business days from said damage occurrence.

In addition, Client/Participant agrees they are solely responsible, under the same conditions stated herein, for any loss or damage derived by visitors/guests they bring to The Actors Room. This understanding of shared responsibility, on the client/participant’s part will be enforced until said visitor/guest has signed a “Statement of Responsibility and Reimbursement” Agreement.

We all want to stay healthy. Please remember to follow the simple tips/rules put in place by TAR to help lesson, or stop, the spread of viruses and other health related concerns while in attendance at The Actors Room:

1. If you’re feeling under the weather, sick or ill in any way - please stay home. If you are up to it, attend class remotely. This is up to you to arrange with your class peers, prior to class start times (use the private group forum).
2. Wash your hands with warm water and soap before entering.
3. Wear a mask if you feel the need to do so. There is conflicting data on the actual effectiveness of wearing one, and other health related effects that may occur from use. That said, it is proven to be some measure of protection against the transmission of certain germs.
4. Use hand sanitizer or sanitizer wipes - As often as needed.
5. Communication distancing is important. No one likes someone in their personal space. Sitting or standing with proper distancing, when possible, is wise. We all have busy lives and take a bit of where we’ve been with us… so, let’s share our talent not germs.
6. By attending The Actors Room, or any public gathering, you understand the risks and possible health concerns involved. As such, by attending, you agree to hold harmless The Actors Room, its affiliates, owners or clients from any and all responsibility.

No pictures, recordings or videos are allowed to be taken or recorded with any device, on the premises, without prior permission from management. This is to protect the personal privacy of those attending, in accordance with The Actors Room Studio participation regulations.
